  1. Better yet ,. how did you get married without a US birth certificate or a US drivers license or some US ID ? These can't be issued without proper US ID's. Unless you used a false US ID. In that case your butt should be sent back to where you came from and never be allowed to return. Why can't people just follow the law!!! Our country does not have "FREE RIDE" in the anthem!

    Here is an answer for you and additional reading, and I suggest you pay close attention to the new immigration reform bill they are talking about because as it goes now. illegals WILL be sent back to their country. Have to pay a $5500.00 fine and LEARN english and also reapply to reenter this country.

  2. one can always enter a country illegally but to marry would be a total different story , you will have to prove your identity ,and that would be harder without the right papers in your possession

  3. it depends on how you illegally entered here. i would contact your local INS office and ask them. to find that number, go to the INS website:  www.uscis.gov  if the offense isn't bad, then there is going to be tons and tons of paperwork to do, lots of money to spend and many many many trips to the INS to be here legally. my husband and I went through that whole process to have him stay here legally and we just finished everything last january. we started in June 2001.  the very best of luck to you!

  4. You would be eligible for deportation. Being married to an American confers no special status if you enter the U.S. illegally - you are still an illegal alien.

  8. Dognhorse is right...... it is hard enough to marry a foriegn citizen overseas and then arrange the paperwork. So if one marries a US citizen in the US and are illegal it would take forever and deportation is likely. What do you think the court would think?

    My understanding in all of this is that the illegal needs to return home. Then you do another marriage in their home country and apply. But here is the danger..... the marriage does not work out say after years. The couple has assets and a house and all of that. When it comes to the split the US citizen can have the others legal rights to be in the US taken away. The illegal will claim fraud or something but when it comes down to it the nonlegal citizen loses all rights and to fight that would cost huge amounts of money.

    Yes the US is screwed up in many ways w. immigration but just marrying a citizen gets one nowhere.

As others have said, marriage to a US citizen (which, by the way, you don't need a US ID to perform:  tourists marry all the time in the US, using their foreign passports for identity) will not confer any legal status on you.  You would have to apply for an adjustment of status, but if you entered without inspection AOS would not be allowed.  You would have to leave the US and apply for an immigrant visa - petitioned by your spouse - overseas.  The likelihood that you would not be granted the visa, since you are inadmissable due to the illegal entry - is very high.

  11. You need to consult an immigration attorney. If you had legal residency, you could be qualified to apply for citizenship after a period of time. However, since you entered illegally, you don't necessarily have that right.
