What if a police officer arrests someone and then says just kidding?

Could a cop get in trouble for that?

  1. no police officer in his right mind is going to arrest you then just say"just kidding".


  2. That sounds like false arrest,and if it happened to you than you should file a complaint. That is a clear abuse of power,

    and the cop should have to answer for it.

    If you can prove it happened,you could even file a lawsuit.

If a police officer places someone under full arrest (meaning that the officer stated that you were 'Under arrest", placed you in handcuffs, and read you your miranda rights "you have the right to remain silent...etc) and THEN says "just kidding", then YES, he violated the law.    If this exact circumstance happened to you...then yes, he broke the law.   Now, if he decided to let you go without citing you or taking you to jail and he simply released you from custody, then no, he didn't break the law.   (I think the deciding factor here as to if it was legal or not would be the words that he used.....if he said "just kidding" then it was a total violation.   If he said something like "I'll let you go this time with a warning and don't do it again", then he did not break the law.

    If he DID say "just kidding", you can file a report on the officer at the police station.    (If you are a minor, be sure to have one of your parents with you.)    Make sure that you have all the facts...when this happened(time and date), where it happened (what street, etc), if there were any witnesses, what the officer's name and/or badge number was, etc.

  5. Yes and no. It would seem to be to a degree a form of fraudulent behavior.Proving this in a court of law is another thing. To some extent police officers are allowed some discretionary behavior in order to obtain fruitful results in a scenario of deception.Unless you were severely compromised I would think that your options are very limited.

  6. If a cop mess with you like that report them to internal affairs.

    You can sue a police department for that.
