Question:

What if any president declared martial Law?

given that the military is subject to president and he declared martial law will the military obey or not?if not then a military leader would have to take command or maybe the joint chiefs would.

if such a thing happened would the military still be dedicated to the principle of civilian rule and relenquish command to a new civilian leader?

ignore the laws in place they can be disregarded by whoever has the power.

the point is. are we as a nation dedicated to the constitution?

  1. The President can declare martial law, but Congress has to accept the declaration to make it happen. Congress has three options: it can decide not to act, effectively accepting martial law by failing to stop it; it can agree to the declaration, putting the official stamp of approval on the declaration; or it can reject the President's imposition of martial law.

    Even under martial law, the three branches of government remain in place; military leaders do not assume leadership of the country.

    Martial law has been declared many times in US history in specific places for specific reasons, most recently in New Orleans from August 26 to September 25, 2005, in the wake of Hurricane Katrina.

  3. I honestly believe it depends on the conditions. Most likely if say a disaster happened say in New Orleans, then it would go without a hitch. However, I think if it happened without a cause (say if the president wishes to overthrow the government) in attempt for supreme political power, I think it would cause a division within the ranks of the military. Half would fight it, half might go along with it. This of course would be a huge monkey wrench in such plans. I am betting if martial law was declared, it would be done with a military group outside and not loyal to the government, but the president himself. A good example is Black water being used to instill order instead of regular troops for their loyalty would be 100 percent to the person in office, not to the old and constitutional regime.

  4. it would have to be a very important reason to, yes the troops would obey, We don't have enough troops to do it anyway.

  5. Thankfully the founding fathers had the foresight to include the second amendment to the Constitution which is the ultimate check and balance for all governmental abuse.
