Question:

What if he's a NO SHOW at Rule Nisi hearing?

Okay tomorrow is the day. AT an initial hearing a judge slapped me with a 1 year restraining order. I filed a motion to dismiss because I'm innocent and want my freedom back. The Rule Nisi hearing is tomorrow. The 'scared' man (plaintiff) tried to get a continuance but the clerks mishandled it so the date has not been rescheduled. His reasons for a continuance were booked and paid business trips.

If he goes on the business trips and doesn't not have a lawyer present tomorrow, do you think the case will be dismissed? Rescheduled?

ARe Rule Nisi hearings short or all day affairs? I went to women's advocate groups and they've never been to a Rule Nisi hearing because most Respondent's even innocent one's don't bother appealing or motion to dismiss.

The women's advocate groups say it's more 'empowering' to live with a restraining order because if you try to dismiss even if you're innocent, you might upset the judge or make yourself cry more. As you can tell I don't listen to women's advocates.

  1. You should post this Law & Ethics.

  2. What is it for?  From what I can see a rule nisi is a decree nisi; right? Which is in regard to divorce or foreclosure.

  3. You won't like my answer, but here goes.

If he has booked and confirmed business trips, then this may well be a valid cause for him not to attend.  Take it up with the clerks if the dates for the resheduling were screwed up, or he should.

Decree Nisi's are short affairs unless there are challenges.

If you have a restraining order on you, then the court must have felt it appropriate at the time.  Sorry, but I rather doubt that there is no basis for it.  Contest it, sure, but as a man who had to take one out on his ex-wife, I can say that the 'scared man' may actually be that.  I feel you have not told us everything here.  Overall, I cannot judge the fairness of the restraint, but, as I said, I think there is more to this than you are saying.

The advocate group is the last sort of people you should lend an ear too.  They just want to manipulate you.

Talk to your lawyer and get some proper advice.  This is certainly not the place.

  4. This aint the place unless your looking for a pat on the back for being an empowered woman.

Seemingly one sufficently empowered as to have succesfully gained a restraining order against her.
