What if my wife's OPT expires before her green card gets approved.?

I am a citizen and just got married. We are in the process of getting a green card for my wife. What if we do not get it by the time her OPT expires?

  1. Once she gets Receipt Notice of I-485 application, her status will be AOS (Adjustment of Status) Pending status which is totally legal. Although after OPT expires, she cannot work until she gets EAD based on AOS Pending.

So long as you file the petition and I-485 Adjustment of status form while she is still 'in status' (OPT) then she is allowed to remain in the United States until a decision is made on your petition and adjustment. She cannot keep working though, unless she files and is approved for another EAD card (Employment Authorization Document).

  3. The girls above r right.  U just need to make sure you file for adjustment of status right away.
