What if the police search my house without warrant or consent?

(Under the Fourth,Second&Ninth Amendments) When any officer entering my home and being notified to leave immediately,(but disrespecting my requests and prior notifications of force,) what would be the lawful consequences of striking,stabbing, or shooting,or tazering the officers? to repel them from my property?(to wound/disable)

  1. I'm pretty sure it's always a crime to assault a police officer no matter what the situation.  You can even be arrested for assaulting an off duty/plain clothes officer.  If the police search your home without a warrant or your consent and find something illegal, whatever they find can't be used in court because they violated your rights.

  3. This would really depend on the cop involved.

    A very few would respect your wishes, leave and go get a warrant.

    However, the vast majority of cops are not very nice and are scam artists of sorts. In most cases they will get very pissed off at you and would simple make a warrant "appear" on a retroactive basis.

    I had this issue before. The police came out to break up this party and they were going into the house and I told them that they were violating my 4th amendment rights and the cop screamed at me and told me that if I did not leave right away that I would be thrown in jail. (He was very angry with me!)

    As far as striking, stabbing, shooting or tazering an officer you would be really messed up and would end up in jail for a very long time and depending on the state and the circumstances might even get the death penalty. The cops HATE people who mess with their follow officers and you would be punished very bad for doing harm to any kind of law enforcement officer.

    The bottom line is don't even mess with cops. Your best bet if you do not wish to get beat up and/or get thrown in jail is to simple not have contact with them in the first place. I know that this is not always possible but you should try your best to have as little contact with the cops as possible.


  4. You should report that in, they cannot search your house without a warrant or consent. You also can't use physical harm towards the police or that will be a charge against you and possible jail time.  

  5. In order to use force against an officer you would have to prove that you had reasonable expectations that the officer was going to harm you without cause . A verbal threat , a violent act against another member of the household (possibly a pet) , or such .

    I have most of the interior of my home video recorded 24/7 . I advise everyone to do this .

    Also you should not strike out against an armed person unless you know what you are doing . No sense getting hurt yourself . You can always sue .

    They have not ethics now a days and lie and manipulate things and modifiy the truth to fit their s***w ups.

  7. You can file a complaint or a law suit if necessary.  I would strongly, strongly advise you not to get violent with the police, as you may get hurt.

  8. Just pick up the phone and announce to the officers that you are calling your Lawyer. Maybe this will discourage them to carry on with their search. No violence please as nothing good will come out of it.

  9. If they have probable cause, they can search your home without a warrant. They just have to be able to prove probably cause in court. It's never okay to assault a police officer.

  10. If the only people in the house are under 18, they have everyright to search your home. If not, they shouldn't be able to enter and search. BUT YES- Assaulting officers in any situation will get you in trouble. sad but true

  11. is this an ongoing problem for you?  Lifestyle change time.  And think about it...how often do you get down to the range? Cops...frequently.  How much practical hand to hand combat do you know?.....cops..a lot.How much body armor do you wear?....cops...enough.  And if you attack a cop succewsfully your name will go on a really big s--t list and your life will really suck from then on
