  1. To be considered eligible for leave under FMLA, an employee must satisfy all three tests:

    Minimum Service Requirement: The employee has worked for the employer for at least 12 months at the time the leave is to commence. (These 12 months are not required to be consecutive.)

    Minimum Hours Requirement: The employee has worked for the employer for at least 1,250 hours during the 12-month period before the leave begins. (These months must be consecutive.)

    Minimum Employee Count Requirement: The employee works at a work site that employs at least 50 employees at or within a 75-mile radius of that worksite

    The law allows eligible employees to take up to 12 workweeks for leave during any 12-month period. If you need to take longer you will have to go on disability.
