  1. Arbitration is where two parties state their case, and the arbiter makes a decision as to who has the best case.  That party wins.

    Mediation is sitting down with both parties to find a common ground and a good compromise.

    Negotiation is very similar, where two parties 'give and take' on certain issues to come to an acceptable agreement.


  2. Many times rather than to address a circumstance within the courts a remedy may be provided for the issue to be addressed via arbitrition,remember however that many processes that use arbitrition may not allow a defendent their full rights as a court would,and a decision  made is binding,and cannot be appealed.
