  1. In order to garnish your wages they had to get a judgment against you.  A judgment lasts 10 years or until it is paid off, whichever comes first.


  2. The limitations on how much can ge garnished is 80% of net earnings.  This means they can only garnish 80% of what ever you have left over after expenses such as Fed witholdings, state income (if applicable) mortgage, auto payments and any other set monthly payments.

    A judgment is listed for 20 years.

    NOW, if you are refering to how much time a collector has to collect in court then it would be as follows

    Open Account (credit card):  6 years

              Written Contract: 6 years

              Domestic Judgment: 20 years

              Foreign Judgment: 20 years
