  1. It's when a claim is settled and the insurance company assumes your rights to sue the party that caused the damage. (someone hits your car, insurance pays for your car, then sues the person who hit you to get its money back)

    the sub. specialist is just the staff member who works on this for the insurance co.


  2. When an insurance company pays your claim it acquires what legal rights you would of had and therefore can pursue the negligent party to recover what it paid to you. The insurance company is subrogated to your rights.

    As an example if your garage burned down the insurance company would pay to replace the garage but if the cause of the fire was your neighbor burning leaves in close proximity the company would assume your legal right to sue the neighbor.

    The subrogation specialist is the one that reviews the paid claims to see if there is a possibility of recovering the loss from a negligent party and then seeks the recovery.

    Think of "Subrogation" as just a fancy legal word for "collections."

    When your insurance company pays you for a claim that somebody else caused, per the policy provisions, they take over your right to collect reimbursement from the at-fault party. The insurance company will go after the at-fault party for the money they paid, plus they will collect back your deductible for you.

    A subrogation specialist is a claims adjuster who handles subrogation claims against at-fault parties. These at-fault parties could be anybody from an uninsured driver to a company who manufactured a defective faucet that caused water damage to a house. The act of subrogating a file can take a long time and they sometimes end up in arbitration or a lawsuit. A subrogation adjusters job is never dull as they deal with many different types of claims each week.
