my son was giving a year from his court last year to serve his community service in April (after 8 months probation) His probation officer said he was in violation, because he hadn't done it yet. so now he was given a date to remove the Set Aside and now it is a Criminal Setting? what does that mean?

Will he go to jail or get extended probation.

He has 2 babies and 1 on the way.

  1. In other words...he's going before the Judge who will determine if he was in violation of probation and what the court will do for further punishment!

  2. His parenthood status makes no difference to the Court.

If he was on probation and had to complete community service and did not do so (not very responsible for a guy worried about his kids, IMHO) then he will probably go to jail for violating his probation.
