  1. You could realistically get quite a bit more.  You should not be speaking with the insurance company without an attorney because you will not be getting a fair settlement.  You need to speak with an attorney and have him/her deal with this.

  2. As the claims negotiation process moves towards a close, you’re settlement demands are very often too low or too high.

When you attempt to negotiate a settlement with these handicaps, you run a strong chance of being victimized.

The amount of compensation you should be paid isn’t found in a crystal ball. Rather, a number of simple factors such as the type of accident, related injuries, out-of-pocket expenses, medical costs and lost wages all go into determining how much a claim is worth. What amount an insurance company is willing to pay actually falls into a fairly narrow spectrum.

"Pain and suffering is a legal term that includes all problems a

person may experience as a result of an accident.

The legal definition of pain and suffering includes the loss of

physical abilities, such as the use of your hand or foot, and physical

discomfort, such as chronic backache or stiffness in your neck. The

term also includes any emotional pain you might suffer, such as worry,

anxiety, embarrassment, and the loss of the pleasures and enjoyment of life."

So to sum it up go for the max and work from there and good luck.

  3. Unless you get your own lawyer, you are at the mercy of his insurance company. Tell their Insurance company that you want to wait for payment until you have further explored your options. Their offer sounds low; did they pay for your medical expenses and loss of wages in addition to their current offer? Will they pay for future medical, rehabilitation expenses, and lifestyle changes in addition to the offer?

I smashed my left femur 25 years ago in a skiing accident and still have 2 bars and a bunch of screws in there. It still bothers me on longer walks than - say a trip to the supermarket.
