i have a civil case pending against me. it says failure to appear or pay the fine will result in a judgment of affidavit?

  1. I have never heard of a Judgment of Affidavit, however each state is different. In most states if you owe money for example to a credit card company, they will eventually file a civil suit against you seeking judgment. You will be sent a letter telling you that you have 20 days to respond to the court. Then you will receive another notice giving you an additional 10 days. If you do not respond within that time-frame then the judgment will be awarded to the plaintiff (creditor).

    Following the judgment, several things can happen. They can: a. place a lien against your home or other property, b. garnish wages in some states, c. conduct a sheriff inventory sale (this involves the sheriff coming into your home to assess what you have of value that they can sell to repay your debt), d. bank garnishment (typically $300 is exempt but anything over can be removed from your checking and savings account.   2. Well, it's likely it says that failure to appear or pay the fine will result in a judgment against you.  But I don't think there's anything called a "judgment of affidavit."  You may be misreading something or taking words out of context.
