  1. It's when you return part of the commission to someone else.  In insurance, it's a form of rebating, and is illegal in all 50 states - you can lose your license over it.

    If you are speaking of a kickback taking place under the laws of another jurisdiction, then American laws will not prevail.

    However, that certainly does not mean that it would be legal elsewhere.  Here, in the USA, we are not allowed to do it.

    Specifically, if Adam tells his friend Brian to buy a policy from Charlie, then Charlie may receive a commission (on the manifest assumption the policy is issued by the carrier and accepted by the owner - usually the insured.)  If Charlie gives Adam a 'finder's fee', that is a kickback.

    You may then write to Charlie at the county jail.
