  1. You could file bankruptcy which would be better than defaulting on the balance.The credit card company will get a judgement against you, which will effect your credit far longer than bankruptcy would.


  2. It is an empty threat, as it costs credit card companies more to sue, than they can recover.

  3. When you applied for credit you agreed to pay the bill.  If you do not; then you get what is coming.  A trip to court and a fee and you have to pay the bill anyway.

Banks sue all the time for failure to pay credit cards.  It is usually done by a company that buys your account from the bank.  Do not listen to advise of those that answer your question telling you to file for bankruptcy.  You have clearly not given enough facts for such advise to be given.  Although a judgment stays on your credit report longer than a bankruptcy, it does not effect your credit like a bankruptcy.  You only go bankrupt if you have significant debt.
