This is permanent damage which causes me to always be in pain. I live in the state of New Jersey. WHat would be a proper settlement for an injury like this?

  1. Well I'm assuming it's a work comp claim.

It depends, where you a surgical candidate?  Did you lose any limbs?  How much damage was there and how much is it affecting your life?  Whats your range of motion?

There are a ton of questions, and each state is different.  Assuming no lost limbs or sensations and just pain it can be probably $0-$5500 as a permanent partial disability (PPD).  Most PPD awards are normally reserved for those who had surgery, however some states allow it for range of motion lost and sensation, so you might be lucky to get some cash...however unfortunate that it happened to you.

If you don't like the award, check with the state about possible challenges to get a PPD award.  Some states allow it and you can also see if your adjuster will settle for a higher amount, just be aware by settling you might have to give up future benefits, like aggrervation rights and re-opening claim (full wash).

    Good luck

  2. Maybe nothing.  It depends on what kind of claim it is (auto, workers comp, liability slip & fall, etc), what the percentage of impairment is (sounds like none), etc.

Doesn't sound like it's worth much to me, though, sorry.
