They contacted me recently and asked if I was pursuing injury claim. I dont want to use lawyer and need some advice on how to proceed to settle with them. Thanks.

  1. You say that you do not want to use a lawyer, but you do not say why.

The insurance company is expert in these matters and you have little or no information upon which to base a decision on what would be a fair settlement.

You state that it is almost two years ago that the injury occurred.  Is the insurance company stalling you past the time you could file a lawsuit?  Ask your attorney about the statute of limitations.  If you go past that time, they may offer you nothing at all, and there would be nothing you could do about it.

Consult an attorney immediately.  There is no good reason not to do so.

  2. They are calling because the statute of limitations is almost up.  If you have "soft tissue injury" and have returned to work, etc., the amount will be small and a percentage will be shared with an attorney.

Get a consult with an attorney but beware, shadier ones will promise high settlements to get your business.  Then, perhaps speak with the ins.company regarding what they feel is a reasonable settlement without going to court.

  3. you need a lawyer
