What is considered personal property during a divorce ?

My sister lived with a guy for 16 years and have 1 child together ,she has a protective order against him ,he wants to take everything out of their house . Is furniture and appliences ,personal property ?

  1. EVERYTHING except the house is personal property.

Personal property refers to what a person needs/uses for him/herself such as clothes, personal hygiene products, tools needed for business purposes, or items purchased for the exclusive use of one individual. If your sister gives anything to her former husband, she should record what they are. Some states will take this into consideration when they settle the division of property.

  3. It would depend on if he had it before they got together. Anything like that bought during the relationship is usually community property since both people contributed to buying it (except for things like clothes). If they never married, it can become more tricky. If I was her, I would talk to an attorney. This is way to complicated for this site.

  4. Personal property is what he 0r she had before the get together> And who payed for it After> Have her change the locks if she is concerned on him removing her belongings>But if his let him have them>
