What is considered personal property?

I had my boyfriend whom I have lived with for 16 years arrested for trying to beat me,I have a protective order on him he is asking for his personal property.I'm not sure what is personal and what is household.We also have a 15 year old daughter.

  1. personal property means property that is not real property.  Real property is land.  Personal property is everything else.  As to what belongs to him and what belongs to you, I can't say because I don't know how anything was acquired.  BTW, contacting you to try to get the stuff is probably a violation of the protective order.  


  2. Give him his belongings whatever they may be. If your finished with him you don't need to keep his things as that will only keep him around. If you don't agree with whats his and whats yours then settle it in court.

  3. Just give him his clothes and personal items like toiletries.

  4. Anything that he had...prior to the relationship and whatever he bought that he needs for himself to live.   (clothes, shoes, shaving items, personal letters, mail)    Anything (personal)   that does not mean jointly!

  5. Anything that he would take with him in a move.

    Also "jointly" held property or household property belongs as much to him as it does to you.  

    He may be a creep for hitting you--- but he's a creep who has equal ownership interest in joint (household) property.

    So - he is entitled to his personal items and 50% of the household property. You will have to work something out with him on the joint property. Either the two of you will have to decide who takes what or you will keep the property and have to buy out his interest in it.

    Since you have a protective order - you should probably consult an attorney on how to divide the joint property/assets.
