i think marihuana was used back in the 30's because if i can remember i think that is how it is spelled on the Reefer Madness movie for schools. So marijuana is probably the modern spelling

In Spanish the "j" is pronounced like an "h", so in some of the early legal documents the spelling was changed to be phonetically correct in English.
