  1. The eligibility for students with Emotional Disturbance (we say that instead of Handicapped nowadays) hasn't changed much since first published in the late 60's:

    "...a condition exhibiting one or more of the following characteristics over a long period of time and to a marked degree that adversely affects a child's educational performance--

    (A) An inability to learn that cannot be explained by intellectual, sensory, or health factors.

    (B) An inability to build or maintain satisfactory interpersonal relationships with peers and teachers.

    (C) Inappropriate types of behavior or feelings under normal circumstances.

    (D) A general pervasive mood of unhappiness or depression.

    (E) A tendency to develop physical symptoms or fears associated with personal or school problems." [Code of Federal Regulations, Title 34, Section 300.7(c)(4)(i)]

    As defined by the IDEA, emotional disturbance includes schizophrenia but does not apply to children who are socially maladjusted, unless it is determined that they have an emotional disturbance. [Code of Federal Regulation, Title 34, Section 300.7(c)(4)(ii)]  Excluding people with 'social maladjustments' is supposed to address folks who have grown up in poverty, children who have had negative role models or different/ineffective parenting.

    A team of professionals must make this decision, but generally a medical professional has determined the child to have a menthal health disorder first.  This is not necessary for schools to apply the label, however.

    The classes are supposed to focus on behavior, rather than academics. In these classrooms, most have level systems or other type of behavior improvement programs.  If a child has a diagnosis of something, but ED doesn't fit, the child can also be labeled with an "Other Health Impairment".  Mental health therapy is also provided to most students in school, but I generally refer parents to outside agencies as well, so families can get comprehensive community services.


  2. The term "emotional disturbance" is a general phrase that can mean any number of things.  It is usually used to qualify a student for special education services because their emotional problems interfere with being able to function well in school- "educational provisions" would be the extra help the person would be entitled to receive in school.

    The label can be for specific disorders such as depression, schizophrenia, bipolar, adhd, anxiety and others that interfere with the student being able to learn in school without the extra help.  The label must be given by a psychologist or medical doctor, and usually requires a team (teachers and family) to agree.

    The educational provisions are the "accommodations or modifications" that the student needs to make education as accessible as it is for students without disabilities.  They should be individualized for that particular student. For instance a student with ADHD may require more help staying on track with assignments like more reminders from a teacher without getting yelled at, help using a homework log, or fewer math problems to do; a student with bipolar disorder should be allowed to go calm down somewhere if stressed out, or may need a special discipline plan.
