What is fair compensation for getting choked on a foreign object at a restaurant?

I became choked on a piece of plastic wrap that was in my pasta at a restaurant. Their insurance company is going to contact me and I was wondering what compensation other people may have asked for or what seems fair to ask for.

I was with my husband and 20 mth. old son and we were out for my birthday. I got choked, was able to cough and gag it up on my plate, and then cried from being scared and embarrassed. I don't know what to ask for now. That's like asking to put a price on my life. So what's fair?

  1. As a server in a well-known restaurant chain I am appalled that this happened to you. You could've died because of their negligence! I would most certainly call a lawyer asap, and stop dealing with the restaurant altogether. Let the lawyer handle any correspondence and put it all in their hands. I'd say you have a fair shot at a decent amount of money.


  2. You should sue. Ask an attorney what is fair, but I don't think a free meal covers it. I wouldn't ever eat thier again. I bit into a chicken bone in a dish I was eating while out to dinner with my family; I was seven months pregnant and broke off a piece of my tooth. My husband was pi$$ed. All they did was comp my meal. The manager was really concerned and kept asking if I was okay. It's hard to call when something like that happens. You actually chocked though, and you deserve to be properly compensated. Call a lawyer.

  3. they should cover the meal and maybe one more for the family to make it up...
