  1. It's about cooperation between the U.S. and India on nuclear energy, not about disarmament.

    The Atomic Energy Act of 1954 prevents the U.S. from cooperating on nuclear energy with any country that has nuclear weapons, as India does, or that's developing them.  The Henry Hyde Act, passed by Congress in 2006, gave President Bush the authority to make an exception for India.  It was named after Representative Henry Hyde of Illinois, its main sponsor in Congress.

    India and the U.S. then negotiated an ageement for cooperating on nuclear energy.  This is known as a 123 agreement because section 123 of the Atomic Energy Act of 1954 authorizes such agreements.  It was announced last month and still has to be approved by the Indian Parliament and the U.S. Congress.
