What is "reasonable enjoyment" of a rental property?

My lease has a clause in it where I can not paint the appartment but the Residential Tenancies Act, 2006

has a clause about "reasonable enjoyment" of the property.

The current colour is a depressing beige. The colours I want are pale colours, easy to paint over, but actual colours. If the rooms in question remain beige i will have trouble enjoying the property.

Do I have a leg to stand on or not?

  1. No.  You signed the lease.  You can't paint the apartment.  You can ask the landlord for permission.  You may have to repaint when you leave.


  2. No, you do not.reasonable enjoyment does not include changing the rental property without the owners consent.You may enjoy the area. If you need to  change the  appearance for your own satisfaction, then add stand up panels around the room, sort of like room dividers, or  removable wall hangings.You could be charged with destruction of property if you alter this area. If you rented a car, and had it painted, you would face the same prosecution for destruction.

  4. Nope.  You shouldn't have rented the place if you didn't like the colors.  When it comes to reasonable enjoyment they mean things more along the lines of noise level, general maintenance of the property (everything is in working condition) and things of that sort.

  6. "reasonable enjoyment" has more to do with the quality of life at the complex. Examples would be if a business moved in next door and they were very loud at all hours of the day/night. You have an expectation of "reasonable enjoyment" concerning noise.

    It wont "fly" with the depressing beige color. Besides, you rented it with that color :)
