What is sentence for felony identity theft in Ohio?

Someone stole my credit card and charged less than $500, and I don't think it was a 1st offense. What charges does this carry if it is and is not a 1st offense, and what sort of punishment will he receive? We're in Ohio.

  1. Assuming the person was identified and can be charged, they should be charged with:

    Theft (misdemeanor)

    Theft of Identity (felony)

    Misuse of Credit Cards (misdemeanor)

    Forgery (felony)



    What the potential sentence and the actual sentence are usually very different.  Some first offenders get away with probation and restitution.  

    I know you said this is not a first offense, the sentence is going to vary depending on the court, how cooperative they were, and their past record.
