What is the average percent you get for pain and suffer due to accident? I was in a car accident and awaiting a settlement offering. Does anyone know the percent or amount one should be offered for pain and suffering?

  1. There is no formula!! It is NOT tied to your amount of medical bills (if you need an example for me to easily disprove that just ask and I will provide). It is determined based on what similar claims in your area have settled for in the past.


  2. in a lot of cases, you'll hear something like "2 to 3 times your specials" which would be your medical treatment, therapy, rehab.......that's why attorneys usually keep having you got to "stroke and joke" clinics to run up your medical bills.

    The question boils down to this "Are you REALLY injured? Or, are you just sore?"

    Just remember that an attorney will normally take 30-40% plus expenses of anything that the insurance company offers and it will normally take LONGER with an attorney involved.

    Wait to see what the insurance company offers you and see if you think it's fair.  Married? Don't forget to ask for "loss of consortium" - wow, then they will KNOW you've been doing your homework!  Loss of consortium is the fact that your spouse has to listen to you moan and groan and that you aren;t able to carry on in your usual ways.

There is no "average" payment.  It could range from absolutely nothing to  a few thousand to .... who knows.  It depends on the situation and the lawyer.  Make sure you do not take a cash settlement or sign anything   if you are still not back to 100%.... Generally if you take a cash settlement that's the full amount you'll ever have to take care of any problems arising from the accident.   Check with a knowledgeable attorney......
