Question:

What is the bank's responsibility if they lose a deposit and they admit that they lost the check?

I had made a deposit which they bank has record of but has misplaced the check. Even though the bank has temporarily credited my account for the money, they say that they will look for the check and if they do not find it, they will take away the money. If the bank has lost the check which I deposited with a teller inside the bank, why should I lose money?

  1. You'll need to get proof of the cleared deposit. If you used a check, you can show them a cleared check image. If it was a money order, contact where you got the check and have them provide you with a proof of receipt. It will show the ABA of the completed depositary institution. . .Otherwise, hopefully you have your receipt. Worst case, ask to speak to a manager, and they can always review tapes and teller work from the day. More than likely, I don't see how you could lose out there.


  2. You shouldn't if you received a deposit slip. Who was it that told you this? Also, which bank is this? Contact the branch manager, and if he/she doesn't help you, continue to go higher up. You could also go to a different branch and contact the branch manager there.

    If they don't help you, take them to small claims court. If you file with the court, chances are the bank won't want to waste its time, and will just credit the money to your account.

    If you know the person who sent the check, you could just ask them to send you another check (that might be easier).
