What is the best thing I can do at this messy situation?

Will be ex-, took home equity line of credit under his name but again the house we bought together(still has little mortgage) without me knowing and signing(i have just read the document, no my name, no signature, no fault signature, too). He lost the $ and lost job. what should I do? Can I sue the second lender?(if the lender didn't sign this loan.. my life won't be this messy, the house is almost paid , now it is all borrowed and in debt.) How can I protect my kids and I from the lender take the house or after my assets?

  1. If you do not get advice from a competent Real Estate attorney, I can promise you a very messy situation.  Your Divorce Lawyer is probably NOT such an attorney.  

    If you do get competent help, it may actually be very simple, but it depends on the facts (looking at the document itself and the applicable state law, and your other finances).  The Divorce Lawyer will know what to DO with the facts, but should not be relied on to unravel the facts themself.

    I'd be curious to know why the lender accepted only one owner's signature.  I'd be looking to see if that's a sign of some kind of Fraud, or if they are just plain incompetent.

If he's about to be your ex, talk to your lawyer.  If you don't have one, get one.  If you were married at the time, I would think most states and banks would have required you to sign for the loan against your personal residence.  If he lied to bypass that, then you may be able to get some relief.  Bottom line is that you will be screwed if you don't get this investigated immediately.  Get some real legal advice.
