What is the cheapest and most effecient way to form a LLC?

Also If the business is a web based business with customers all over the U.S., do I need to incorporate in California if I am a California resident?

  1. Many states allow for the creation of single-member LLCs. Other states require two or more members. It is important to remember that the IRS may apply different tax liabilities to a LLC with only one member (taxed as a corporation or disregarded entity for tax purposes) than it does to an LLC with more than one member (taxed as a partnership by default).

    Many people do not realize they can serve as their own registered agent.  The only requirement to become an agent, is to live in the state of the corporation or llc.  So you can serve as registered agent for your own company as long as you can provide a the name and street address within the state that you are filing in.

    An agent for service of process is a individual (or  corporation) designated by a corporation to accept service of process if the corporation is sued. Most states require residency  the only requirement for an individual to be named as an agent for service of process. A registered agent is required for all LLCs and corporations filed in the United States.

    For a corporation to be named as an agent for service of process, this agent must be on file with the Secretary of State persuant to the Corporations Code.

    The registered agent is required to maintain a street address located within your state of filing.

    The name of the registered agent can be changed or the street address may be changed.  If you need to make a change to the agent information, you must notify the Secretary of State. Most states require a fee to make a change to the registered agent information.
