1. Would an American-born woman who marries a South African man, and chooses to live in South Africa, retain her American citizenship? Are there conditions she will have to comply with in order to retain her citizenship?

2. What would be the status of her husband - would he be eligible to apply for a green card/American citizenship? If yes, on what basis will this be possible?

Thank you.

  1. is this about obama no 2 years down the road...............

  2. You keep your US citizenship.  The only way to lose your US citizenship is for you to go to a US embassy, fill out a form, hand in your passport and swear an oath in front of a US consular officer. (There are actually a couple other ways but they involve serving in a foreign military or being an official in a foreign government.)

Your husband would be whatever he is now.  If you wanted to live in the US you could sponsor him for a green card.  It's not automatic.  If he gets his green card he can apply for US citizenship after 3 years.  He must actually live in the US to do this.

  3. Her status would be that of an American woman who has married a South African man & chooses to live abroad. it doesn't affect her US citizenship in any sense. As for her husband, if they intend to live in the US, she could file an immigrant visa petition for her husband, probably at the US embassy there. It would certainly be faster than filing it in the US. Then once he entered the US, he would get a green card and after 3 years of residence, he could file for citizenship. but, it's pretty pointless unless you both intend to actually live in the US.
