What is the common rate for a Texas accident attorney?

My son was rearended, the lady admitted fault and was cited failure to controll speed, totalled both cars and my son was the only one hurt with a compression fracture to the back, he cant even hold his new born son or work to support them for two months plus that we know of. What is the normal percentage that an attorney should charge us if settled out side of trial and the amount if it goes to trial?

I wont swear to it but 25% seems like to me.

Here in california its 60-40 60 for the client and 40 for a lawyer. Some are 70-30 70 for client and 30 for lawyer.
