What is the fastest way to get a job without a green card or social scurity card?

My husband is wanting to switch jobs so that we can move but his green card and social security card were stolen with his wallet 7 years ago. He has remained with the same employer all these years and so has not felt he had a huge need to replace them until now. He has a California driver's license to prove his identity, but he is needing something to prove his employment eligability. We are wanting to move ASAP and I was wondering what would be the fastest documents to prove his work eligability while we wait for his green card?

  4. Go and get your social security card replaced immediately.  It only takes about a couple weeks to get the real thing, and they will give you a print out as a confirmation during the interim.

    A social security card and drivers license is generally enough as documentation for employment in California.

  5. As a foreign national your husband is supposed to carry proof of his legal immigration status at all times (that means his green card). While the fact that he lost his card can happen, that he never sought to replace it is inexcusable and you're both lucky he never got caught.

    As far as proving his employment eligibility, there is nothing you can use short of a green card and a social security card. You could also use an employment authorization card from USCIS but those also need to be applied for, and there is no sense in applying for one if you're a green card holder.

    Allow me to point out that if your husband has been a permanent resident for the past 7 years, then he is eligible to apply for US citizenship if he desires. Once a US citizen, he would not have to worry about all that paperwork so much.

  8. As a new employee, he has to complete an I-9 within 3 days of starting a new job. This form is used to establish identity and eligibility to work.

    The form contains a list of documents that can be used. The new employee has to provide either;

    1) A document that proves both identity and eligibility, or

    2) A document that proves identity AND a document that proves eligibility.

    Since your husband doesn't have his I-551 card (also known as a Green Card), he can provide an unexpired foreign passport with an I-551 stamp inside, if he has it. The stamp, or the card, are the only two documents that establish both identity and eligibility for an LPR.

    If he doesn't have the stamp (and thus doesn't have a single document that establishes both identify and eligibility), he'd have to provide two documents, as mentioned above.

    However, for an LPR, the only document that he could have to establish eligibility is a Social Security Card. Since he doesn't have that, you're out of luck.

    So if he doesn't have an I-551 stamp in his passport, you're going to have to apply for a new I-551 card or a new social security card (the social security card is cheaper). That being said, the law does require all LPRs to carry their I-551 card with them at all times. If he's arrested, he has no proof of his legal status in the US, and that could cause issues.

    If you do apply for a new I-551 card, you could then take the NOA1 (I-797) you receive for your application to a local USCIS office. They may issue with an I-551 stamp while you are waiting for the I-551 card to be produced.

    At the end of the day, you're going to have to apply for something if you don't have a stamp already.
