What is the insurance process when your parked vehicle is hit by an uninsured unlicensed driver?

Our parked car (Australia) was hit in the church carpark by another young parishoner who is unlicensed and unregistered and just mucking around. Our back bumper is now dented. The incident was witnessed by 5 other people. My mother and the other driver were uninjured. This person is an accquaintance and has offered to settle privately. Should we go through our insurance company, we would be compensated immediately, but what are the consequences for the unlicensed driver? I was told that she'd have higher premiums for 5 years, but would there be other consequences? We know the pereson and don't want her to be in trouble in the official records, but then again we just want our car fixed. What would you recommend? Thanks.

  2. You posted this on the USA board, so you're probably going to get all USA answers.  

    Consequences for the other driver are going to vary, depending on their circumstances.  

    If you want your car fixed, and she can't pay for it out of pocket, it's GOING to have to go through your insurance, and she's GOING to have fines, at least.

    There's nothing illegal about handling accidents privately. In fact insurance companies LOVE it when you pay all that premium $$ and never make a claim.

    So it is up to you.
