You have to get a signed release that allows your to film on it.  A famous situation came when Mary Tyler Moore Show came back to Minneapolis to shoot new exteriors, and the owners of the property wanted money for them to shoot it.   Of course  they had already signed releases and so the Show just decided to shoot the house.  When they got there, "Impeach Nixon" was hanging from the roof.  That ended the house being used.  

Now, if you shoot on private property, and the shot is of something not on the property, you would be okay, until told to leave.
