What is the law on equine sales in Virginia?

I purchased a horse from Carvins Cove Stables in Salem Virginia that is not what it was advertised to be. This horse will end up getting someone hurt. I am persueing the Attorney Generals Consumer Protection law.

  1. If you have a copy of the add and a sales contract you should stand a pretty good chance of getting your money back provided you haven't had the horse that long and can prove that they misrepresented the horse.

I think your case would depend on what type of representation they made to you.  Was it in writing, or verbal.  obviously.. if you have something in writing and can prove that this was not true, you may be able to win in court, but these cases often come down to one person's word against another's.  If you could prove the horse had been medicated when you were shown the horse to mask problems, that could help your case too.  What exactly were you told and what is the case now.  Unfortunately, they could argue that you caused this problem.. and that it is new and they didn't experience it.  Hard to prove otherwise depending on what is wrong.  More detail would help here.
