What is the legal age for a child to decide if they want to live with the other parent?

my husbands kids are three four and six. at what point can all this stress be overwith and the the kids choose to live with us?

  1. In ALL state the judge CAN take the child's preference into consideration at ANY age.  While SOME states allow the child to decide at a given age, the age varies by state and the judge CAN overrule the child if they determine it is in the best interest of the child.  Standards to determine that vary and often give the judge wide discretion.


  2. i live in Michigan, i experienced a similar thing. In this state, I believe the age for a child to decide which parent to live with is 12.

  3. No matter what age both parents must agree to child's decision. Otherwise it is back in court and the judge decide's.  No mother is going to allow that just to make your life easier.
