I have handed the resignation letter (hard copy) and my boss has torn and threw that in the dust bin.I have sent a mail attaching the same.

What is the legal standing for the letter?

  1. uh...you aren't a slave. They can't come and get you to work. Keep copy for your records


  2. Can you prove you have sent it? Was it certified or otherwise documented through the mail system? Did you give appropriate notice? I have no idea of your situation, and do not know if your employment includes any security restrictions that you had already agreed to or not, so can't answer in more  detail. I can say that I am aware of situations where separation or retirement (in the USA) can be restricted by government requirements, such as national security, but (again, in the USA) you are not a slave, you are likely allowed to quit an employment when you wish.

  3. Well as the other person commented, they cannot KEEP you there. Keep the letter of resignation copy in your files to have proof of a formal resignation. Some employers are tricky, they'll say they never got the letter and mark you for job abandonment to be able to fire you without benefits or pension or what have you. Be sure that all your information is well recorded/dated to retain as much proof as possible. You never know now a days when you'll have to litigate.
