Question:

What is the legality of accidentally incarcerating and holding on charges already time has been served on.?

I was recently arrested on a dui charge which charges were dropped except they had said i had a commitment with them on a previous charge that i already did time on in 2005. I was held for eight days, housed on cement floors in the county jail until i realised that i was being held for charges i already served time on in 2005. by the time i was able to contact someone who could research this further on the outside i had served 6 days in custody. caused hardship with my family and employment. After the jail researched this issue i goit released immidiately with a "sorry we made a mistake". Do they owe me anything for this "mistake"? what form would i file against he county for lost wages, ect. ect.,?while i was there the jail was overfull which we were housed on the concrete floor for 4 days before even getting a bed.is this even legal or humane?

  1. You would think so.  But they'll bully you into thinking what a bad person you are and lucky to only get 8 days to think about it.

    Unless, of course,  you have lots of money

  3. if your a felon there is no accidental incarceration. even if its not legal police and courts can do anything they want to you,and if you do speak up for yourself you are asking for it,unless you have money for a good lawyer or someone can use you to get elected your screwed, oh i forgot about a video tape.if any cops say this is not true you are lying through your teeth
