What is the most likely punishment for getting caught with manufaturing marijuana if you are a first offender?

the police find three marijuana plants in my buddy's dorm room. he was never arrested and hasnt got into trouble yet. my question is, if he has never been in trouble before, and calls first offenders act, what will he have to pay or what will his most likely punishment be and what should he do

  1. It's dependent on the specific laws of your state.  Some states will consider it a felony regardless of the number of plants or their size, and will show little mercy when it comes to sentencing (think 5 or more years in prison).

    Other state laws are more nuanced and take into account first offender status, quantity of plants, etc.  Check the laws of your state or, better yet, dispose of the plants before getting caught.


  2. All depends.. If your buddy had any buds on the plant and the weight added up to enough then that is possession with intent to distribute, and that gives reasonable cause to search the room and if there is any paraphernalia he may be saved from intent to distribute but will also get hit with a paraphernalia charge... AND they could try to put a cultivating a controlled substance charge on as well, but if its only three plants i doubt it.. I cant believe they didn't arrest or further search this kid.. But lowest he'll get is possession, which is a misdemeanor with about a thousand dollar fine... But yea that's about it

  3. Drug Laws are enforced by race. If your friend is White he will get a slap on the wrist. If he falls into the "other" catagory the court will throw the book at him and make an example out of him.

  4. Depends on your state laws and whether or not they determine you were planning on selling your harvested cannabis.
