What is the name of the lawyer that handles childsupport and can I get the number or can you help me? ?

My friend has been divorced for sometime now, and he was ordered to pay childsupport according the judges order. The only problem is it was based on the salary that he was making at the time. He now has to work two jobs to pay the support and has not been granted an reassessment since his divorce and he lost that job.

This is a brief story of what's going on, can you please help.?

  1. When his income changed he had the right to go back to the court that ordered the child support, and ask them to modify the order.

    He should use the same lawyer he used in the first place. If he can't - or if he didn't use a lawyer back then - he can just look in the phone book. There will be many family law attorneys listed.

  2. There are thousands of lawyers who handle child support.  Your friend may want to consult the attorney he used during the divorce.

    If he did not have a lawyer then or he wants another lawyer, he can use the lawyer referral service of the state bar in his state.

    Yahoo search the terms "lawyer referral service" and the name of his state.  Be careful of sponsored links.  Use the state bar's service.  It is free.

  3. Any family lawyer can assist him.  He just needs to submit an application to the court to have his support order revised to reflect the change in income.  

  4. Your friend needs to ask the court to modify his child support because his situation has changed.  This is called a Motion for Modification.  He can obviously hire a lawyer and should if he is able to afford this, but often courts will assist in matters related to children - custody/support/paternity, etc.  Call or go down to the court where the order was issued and speak to the Clerk's Office - ask them if there is a Family Services Division or if they have self-help kits related to support issues.

    EDIT:  Modifications are not retroactive - even if he lost a job a year ago, the judge does not give a "refund" - your friend should do this as soon as he can.

  5. Many lawyers would deal with that, Contact the Law Society. They will advise on solicitors in your area who could assist. They wont recommend a firm however. Your local CAB may also be able to help.
