I have 3 months of notice period before relieving from my employer. However I want to get out of the company as soon as possible. What does the Indian labour law says in this regard?

  1. You have 3-month notice but you can write a resignation letter and on that letter you explain to your employer that you will be resigning in two weeks that way they can relieve you of your duties but  have to let them know that you will be leaving the company in two weeks.

By doing this is good business ethics and is a good way that you are a very valuable employee

  2. Normally, one has to give notice in writing of leaving one's job and serve the employer for the period of notice from the date of serving such notice before he/she is relieved satisfactorily by the employer. However, there is always a provision to pay or compensate employer financially if one wants to be relieved immediately or at a shorter notice. Generally, it is measured by equivalent amount of salary + financial gains + perks, as have been agreed to in terms of employment agreement, for the period employee doesn't want to serve under the notice period. At times, an employer may waive such notice period as a gesture of goodwill or for other reasons in its sole discretion.

The most appropriate position for you is to get back to your employment agreement and see what is your exact obligation and what alternates are available to you under the agreement.  Additionally, you may also speak to your employer for amicable good bye under mutual consent.

It is quite a possibility that based on your position, amount of salary etc. you may not be covered under the labour laws but under the Contract Act.

Under any situation, look for amicable settlement as your first preference.
