What is the open container law for Indianapolis? And does this apply to ALL cities?

I have heard that the passengers and drivers can both be drinking inside a moving vehicle, provided the driver is below 0.04. Is this true for ALL parts of Indiana?

  1. In Illinois if you have open alcohol in a vehicle you have a problem! Look up your Secretary of State or DMV site.

    Its a good way to lose your driving privileges!! Drinking before or while driving kills and injures innocent people everyday, and I see the aftermath when I go to work.I am a Fire Chief and Emergency Medical Technician. Law or not, its common sense not to do it. Thanks for the question.

Sadly, that law was recently repealed.  According to Indiana Code 9-30-15 it is a Class C infraction (think going to jail for a night and paying a few hundred $$, but non-criminal penalties) to have an open container in a motor vehicle and a class B infraction to knowingly drink while operating one.  I suggest using a flask with only a shot or two of vodka.  This way, if you get pulled over, you can drain the container (vodka has a less obvious smell, and, really, gives you the most bang for the buck anyway).  However, you want to keep from going over a limit, so have less than it would to take to get you drunk (http://www.brad21.org/bac_charts.html) because, really, you just want to drink and drive, not go to jail. (also avoid the hand-held breathalyzer-the deviation for error is almost as large as the legal limit!)  For more information on  IC 9-30-15 go to:

  3. Currently, 39 states meet the full federal requirements (now including Indiana, Montana and Colorado). Further, cops can bust you for having an open container without any probable cause. There are small variations in this law that turn on language parsing (e.g., what qualifies as a moving vehicle and what counts as the passenger area of a motor vehicle).
