  1. Burglary in the 3rd is a class D felony, for which "the term [of inprisonment] shall be fixed by the court, and shall not exceed seven years" (McKinney's Penal Law § 70.00).

    Criminal possession of stolen property in the fifth degree is a class A misdemeanor. (McKinney's Penal Law § 165.40). The sentece of imprisonment is fixed by the court and can't be more than one year (McKinney's Penal Law § 70.15).

    Criminal mishief in the 3rd degree is a class B misdemeanor (McKinney's Penal Law § 145.14). The sentence can't be more than 3 months. (McKinney's Penal Law § 70.15)
