What is the penalty for being under the influence of cocaine in California?

No driving, no drugs found, just cocaine. This would be the first time for this kind of incident and the person is 18 years old.

Being under the influence of cocaine is a violation of Health and Safety Code section 11550.  This is a misdemeanor with a minimum sentence of 90 days, and a maximum of one year.  However, for a first offense, assuming the charge is even filed, the most likely outcome would be deferred entry of judgment under Penal Code section 1000 (a guilty plea followed by a period of probation and counseling, with some fees attached), at the end of which the plea is set aside and the case dismissed with no jail time.

  4. drug diversion program, then it's dismissed. Usually no jail or conviction if first time and go thru drug diversion.
