What is the procedure of a withdrawal by Customs & Border Protection, USA?

The officers said that, they will have to put u under ER 1st & then change it into a withdrawal, what does this mean? Or how is it actually done & I wonder if I can trust the CBP officers anymore, often times they are rude & won't tell me anything but expect me 2 know exactly what I should or should not do.

  1. A "withdrawal" is a procedure done at a port of entry in lieu of an Expedited Removal. An ER is an actual removal order and results in a five-year bar. Instead of doing an ER, sometimes CBP will permit an applicant for admission to withdraw his/her application for admission.

    A withdrawal does not result in a five-year bar so it's actually generous because it does not carry the consequences of a removal order.

    An ER is not done first and then changed to a WD. An ER is considered first, and if the reasons for the inadmissibility can easily be overcome, consideration is given to a withdrawal so that the inadmissible applicant and return home to correct whatever the problem may be, e.g., lack of the correct visa.

    If you were permitted to withdraw, those "rude" officers did you a favor for which you should be thankful. If they had ordered you removed, you would not be able to return to the U.S. for five years. Now, you can sort out the problem, get the right visa, documents, etc., and try again as soon as you are ready.


  2. Are you talking about Expedited Removal?  Then they are giving you a chance to leave voluntarily instead of being held in immigration detention and deported.  You violated immigration laws.  It is up to you to know the law and obey it if you are going to a foreign country!  No wonder the officers are rude -- you break the law and then get shirty about it.  Go back to your own country and stay there.  You cannot be readmitted to the US.
