What is the process of getting probation transferred to a different state?

My boyfriend has a court date next week and may get probation. If he does, he wants to move it from NY to Las Vegas. He has no job there and is using his brothers address. He has never lived there before. Also, he's being charged with a misdemeanor offense. I heard those are also almost impossible to transfer. Either way, does the transfer request require that he stays in NY for the time being? Cause he just wants to shoot back out to Vegas. I want him to calm down and stay for a while anyway.. Will this process make that possible?

  1. The process you are referring to is called an interstate compact. If your boyfriend makes probation, he can ask his PO if his type of case will be accepted.

    As you already know, it is an uphill battle getting most misdemeanors transferred to another state. The deciding factor is the gaining state and whether they want to accept this or not.

    One other note here. To effect a transfer, he would have to have a job previously lined up, a place to stay and someone there to sponsor him first.
