I am a teacher and we have a child who is currently in foster care along with their infant sibling. Next month they go back to court to see if the birth parents get them back, but it is pretty doubtful. What would be the process to go through if I wanted to puruse adopting these siblings?

  1. check with the child's cps worker. there are home studies and parenting classes to take

  2. Hey.  First call your local department of health and family services, or CPS and ask to talk with a social worker.  The worker may or may not talk with you about the children, keeping some of the information confidential.  But, you could find out the process.

But, in general, in order to adopt through the foster care system, you would need to go through training, have background checks, and have a home-study done.  The children would then be placed with you for a "trial period" and to see how things proceed.

The current foster parents might have first rights if they are interested in the children.

Since you seem to already know what is going on (ie next month court), you might try and talk with their current foster parents and find out what their intentions are in regards to adoption.

I don't know the situation, but you must also be aware that TPR (termination of parental rights) can take awhile.  While they are going back to court next month, if the parents are making "any" progress on the case plans, rights will not be terminated (unless the abuse was so severe or there is abandonment).  TPR can be dragged along for awhile because the courts try everything possible to re-unify the child with the original parents (No matter how crazy it might seem)

    Good luck

  3. It varies by state.  You'll need to call the DHS office that's handling the kids' cases, and talk to their case worker.  Best of luck.
