What is the process to go through when you are a U.S. citizen and you marry a non U.S. citizen...?

  2. 1) You citizen apply from the US for a K1 visa for his future wife/husband that is curreectly abroad.

    2) This person comes to the US on K1 visa and get married.

    3) You take the Marriage Certificate and apply for Adjustment of Status and a Workpermit.

    4) After 1-3 months (3 months tops - they promise that) he/she recive a work permit and they can work until they get a Temporary Green-Card.

    5) 3-9 months after applying for Adjustment of Status there is an Interview, and the person will get a Temporary Green-Card.

    6) 3 months before the Temporary Green-Card is 2 years old the person should apply for a Permanent Green-Card.

    7) Few months later he will get a Permanenet Green-Card.

    8) If you are still married for the next 3 years (3 Years after he recieved a Permanenet Green-Card) he will be able to apply for a US citizenship and Passport , he will have a test and if he pass (and he will) he will get his citizenship and then apply for passport.

    9) If he gets his Permanenet green-card and then you are not longer married to him he will have to wait another 4 years (after getting the Permanenet green-card) until he gets his US CITIZENSHIP AND AMERICAN PASSPORT.

    About the investigation, it usually question about your life together and if you live together you will know the answers, plus - you can go to an immigration lawyer and they have all the questions so you could memorize the answers before.

    They asks things like:

    1) So tell me, how did you asked her to marry you? and then in another room they ask you how he asked you to marry him, and they check if it match.

    2) In which side of bed she sleeps? they ask him and then you seperatly and see if it matched.

    Its very easy don't worry. But if this person who is going to marry you look sospicious they will do a Name Check and it can take 1-2 years until he/she gets a Temporary green-card. They usually do not do it unless he/she looks like a terorist.

  3. all you need to do it fill out a fiancee visa for them. and, yes, immigration will interrogate you because so many people fake love to get a green card.

  4. I am a British Citizen and married an American citizen. I was already in the US on a work visa, so we just applied to immigration to adjust my status. From my understanding you can apply for a fiance visa to bring your fiance here, then marry and apply for the greencard, or you can marry then and they can wait in their own country whilst you file the paperwork.  All the forms you need are at www.uscis.gov  You will need to file the appropriate paperwork, pay the fees and provide a TON of supporting documentation.  I am quite familiar with immigation and did a lot of the work for my work based visas myself, but I hired a lawyer for my green card, that is just too important to leave to chance, I wanted to make sure that everything was done right first time around.  You will need to take proof of you relationship, photos, letters, emails, card anything that demonstrates a relationship. If either of you travels to see the other keep airline tickets etc. If you are living together when you apply you will need joint bills and bank account docs. You need pics of the wedding, affadavits from people that know you to say your relationship is real.

    As for the interview, I was VERY nervous about that... but in the end it was really simple, just some easy questions about how we met, when did we get married... stuff like that...I have heard of some strange questions being asked, even officer wanting to see both sets of keys to make sure you each have a house key... but I think they only start acting like that is they suspect you are faking it.  Just make sure that you are ORGANIZED, keep copies of EVERYTHING you submit and when you go to the interview take copies and originals of everything you have supporting you relationship.  If you have any questions, feel free to email me, I have copies of everything I sent to immigration, I found scanning it was best, that way I could just print out whatever I needed :)

    As for the interview/interrogation, it depends. It depends on the country, it depends on the consular officer, it depends on if they're having a bad day, etc. Sometimes they're unpleasant, sometimes they're professional and neither friendly nor unfriendly, or sometimes they're just really nice. Sometimes you don't even get interviewed at all.

    Personally I got my fiance visa and green card without any sort of interview, ever.
