What is the punishment for criminal mischief in the first degree in oregon?

a friend and i were REALLY drunk and destroyed some windows at a local movie theater. this is our first offense. i did get a minor in possession by consumption of alcohol charge when i was 19 years old, but took care of it.

what i want to know is what will be my punishment. i'm really scared and i'm sure he is also (we're not allowed to contact each other). i'm hoping i dont have to go to jail.

i've completely stopped drinking and am attending AA classes now. i dont ever want to mess up like this again

  1. Well, I'd really like to help you, but Oregon's sentencing guidelines are the most confusing ones I've ever read.

    It appears that if the value of the windows was more than $750 it is a class C felony, but if the value was between $100 and $750 it was a Class A Misdemeanor.

    It also appears that they completely ignore the felony/misdemeanor determination during sentencing in favor of damage greater than $1000 having a crime seriousness rating of 3 and damage less than $1000 having a crime seriousness rating of 2.

    Somehow you're supposed to put the crime seriousness rating in their sentencing guidelines grid, but I can't figure out the grid.

    You really need to talk to a lawyer. It seems likely that you will have jail time if you take this to trial and are convicted. However, any decent lawyer should be able to get the charge down to a lesser one that hopefully will only carry probation.

  3. Probably a reward of some sort for th3e criminals, considering how liberal Oregon is.

    Now, not all of Oregon is like this, but liberals in the Portand area and college towns give Oregon a bad name.
