Question:

What is the punishment for delinquent child support in CA?

Just curious, what happens when a non custodial parent is 30 days, 60 days and 90 days past due paying child support through Child Support Services. For the scenario, this parent is also $7,500 behind in support payments.

Added info: it's not me that is behind it is my EX.

  1. If someone is delinquent of child support and they are getting Social Security benefits, their benefits can be garnished.


  2. they can loose their drivers license as well. Depending on situations they can also do jail time. it can keep them from find good work because it now pops up for employees job search. Their life is now h**l my daughter is going through it for herself.  

  3. If your ex is behind because he was laid off, or because he was injured or ill, he won't face criminal charges.  He will be found in civil contempt, and some extra will be tacked on to his future payments until he catches up.

    If he has the means to pay, but just hasn't, or he's quitting jobs (or changing states) to avoid payment, he could be criminally prosecuted.  He could be arrested and held (indefinitely) until he pays.  His driver's license could be suspended till he pays, or punitively for up to a year.  He could also be punitively jailed for up to a year.  He could be  fined.

    Usually, though, it much longer than ninety days before a criminal case is considered.  It's at least a year, and it could be several years.

  4. They can't do anything if they owe $4,999 or less. Once they hit the $5,000 range they will take action against his house if he owns it, and revoke his drivers license. Have you contacted the DCSS and gave them your court order anlong with any and all employment info you have? They will automatically garnish his wages from his check, since he's a dead beat dad and doesn't have a pair.

  5. Good luck in California!!! Don't hold your breath! Even if you go to Court, you can't get blood out of a stone! My daughter-in-law with her first husband, hasn't paid a penny for their two kids for 11 years!! He will just quit his job and move on if you start pressing the issue! Putting him a jail doesn't work - obviously, he's not making a dime in there!!! If you can manage without his help, do so, if he wants to see the kids, arrange a time when you KNOW he probably won't show up, it's YOUR choice, and you don't have to put yourself out for him! You have a life, and it doesn't revolve around him!!  You are NOT denying him the right to see the kids, just making it a little difficult for him! Make him jump to YOUR demands!! If he shows up in a new car or a girl friend, you know d**n well he has money, but rather spend it on himself instead of his kids!!!  Actually, the Courts are supposed to be collecting child support for you, but that doesn't work either! If he does have a job, and know when he gets paid, I would see about having his wages garnished! Talk to your attorney!
